Welcome to the Privacy Policy of Jicki GmbH. Here we inform you about which data is collected and how it is used. This Privacy Policy applies to all websites and apps of Jicki GmbH (hereafter referred to as Jicki Services).
Collection and Processing of Personal Data
Personal data such as name, address, customer number and email address is collected within the Jicki Services only if you provide it to us voluntarily for example during registration, an email inquiry, an online application, a survey, a contest or for the execution of an order.
This personal data is collected and used solely for the purpose of fulfilling contracts or orders and for safeguarding our legitimate business interests with regard to the consultation and support of our customers and the needs based design of our products in accordance with the applicable legal data protection provisions. This data will not be passed on to third parties without your explicit consent unless we are legally required to do so.
With your explicit prior consent or based on data protection regulations allowing such use, we also use the data for the purpose of advertising our own and third party products and services as well as for market and opinion research. Your Right to Access Information and Rectification
You may request information about your personal data processed by us. If your information is not or is no longer accurate you may request rectification. If your data is incomplete you may request completion. If we have shared your information with third parties we will inform them of your rectification provided this is required by law.
Your Right to Erasure
You may request the immediate deletion of your personal data for the following reasons
if your personal data is no longer needed for the purposes for which it was collected
if you withdraw your consent and no other legal basis exists
if you object to the processing and there are no overriding legitimate reasons for the processing
if your personal data has been processed unlawfully

This also applies to consent declarations given to us before the GDPR took effect on 25 May 2018. The withdrawal of consent does not affect the lawfulness of data processing carried out before the withdrawal.
Purpose of Data Storage
We observe the principle of purpose bound use and collect process and store your personal data only to enable maintain and further develop the Jicki Services. Your personal data will not be passed on to third parties without your explicit consent unless this is necessary for the provision of the service or the execution of the contract. Transfer to authorized state institutions and authorities occurs only within the scope of legal disclosure obligations or if we are required by a court decision.
We take internal company data protection very seriously. Our employees and the service providers commissioned by us are obligated to confidentiality and compliance with data protection regulations.
For payment processing we pass on the data necessary for handling the transaction to the payment service provider. If you transmit your payment data directly to the payment service provider we only receive a very limited set of information. The payment provider informs us only whether the transaction for a specific transaction number has been carried out. We do not receive your account data or credit card number. In the case of a violation of third party rights by a user particularly copyright trademark name or labeling rights user data will only be shared with the rights holder if the rights holder substantiates their claims to Jicki GmbH.
Minors
The services of Jicki GmbH are generally intended for adult users. Use by minors without the consent of their guardians is not permitted. Jicki GmbH therefore reserves the right to delete all data related to minor users unless consent from their guardians is present.
Emails
We send emails for various reasons to enable your use of our learning platform. After the registration and payment process we send a registration confirmation or order confirmation. Emails may also concern our services and offers unless you have objected to such use of your data. You may object at any time using the unsubscribe link in the relevant email or by sending an email to [info@jicki.com](mailto:info@jicki.com).
Emails sent by us are stored and emails classified as business correspondence are not deleted during the statutory retention period. For newsletter emails we record for example through tracking pixels whether an email was opened and which links were clicked. We use this data to send you only relevant and interesting content. If you wish to object to this use of data unsubscribe from our newsletter using the unsubscribe link in the email.
Use of the Mailing Service Maileon
The newsletter is sent via Maileon an email newsletter provider based in Germany XQueue GmbH Christian Pleß Str. 11 13 63069 Offenbach am Main, Germany.
The email addresses of our newsletter subscribers and the other data described here are stored on Maileon servers in Germany. Maileon uses this information to send and evaluate newsletters on our behalf. Maileon may also use this data for optimizing its own services such as technical optimization of sending and displaying newsletters or for economic purposes such as determining from which countries recipients come. However Maileon does not use our subscribers data to write to them directly or to share it with third parties.
Registration Data
To sign up for the newsletter it is sufficient to provide your first name and email address. Optionally we ask for your last name. This information is used solely to personalize the newsletter.
Statistical Collection and Analysis
The newsletters contain a web beacon a one pixel file that is retrieved from Maileons server when the newsletter is opened. During this process technical information such as browser details system information IP address and time of retrieval is collected. This data is used to improve services based on technical data or user groups and their reading behavior based on their retrieval locations or access times.
The statistical analysis includes identifying whether newsletters are opened when they are opened and which links are clicked. This information can technically be assigned to individual recipients though neither we nor Maileon seek to monitor individual users. The analyses help us understand reading habits and tailor our content accordingly.
Online Access and Data Management
There are cases where we direct newsletter recipients to Maileon webpages. For example our newsletters contain a link that allows recipients to view the newsletter online. Recipients can also correct data such as their email address.
Please note that cookies are used on Maileon websites and personal data may be processed by Maileon its partners and service providers such as Google Analytics. We have no influence on this data collection. More information can be found in Maileons own privacy policy.
Cancellation and Withdrawal
You may unsubscribe from our newsletter at any time which revokes your consent. This also revokes your consent to newsletter delivery via Maileon and statistical analysis. A separate withdrawal regarding sending via Maileon or statistical analysis is not possible. A link to unsubscribe is provided at the bottom of every newsletter.
Legal Basis under the GDPR
In accordance with the GDPR effective from 25 May 2018 we inform you that consent to send newsletters is based on Art. 6 para. 1 lit. a and Art. 7 GDPR as well as § 7 para. 2 no. 3 and para. 3 UWG. The use of Maileon statistical analysis and logging of registration processes is based on our legitimate interests under Art. 6 para. 1 lit. f GDPR. Our interest is in using a user friendly and secure newsletter system that serves our business interests and meets user expectations.
We also inform you that you may object to the future processing of your personal data according to Art. 21 GDPR at any time. The objection may particularly target processing for direct advertising.
Collection of General Information
When you access our website general information is automatically collected. This includes information such as the type of web browser operating system domain name of your Internet service provider and similar. These do not allow any personal identification. This information is technically necessary for correct delivery of requested web content and arises automatically when using the internet. Anonymous information of this kind is statistically evaluated to optimize our website and the underlying technology.
Cookies
Jicki Services use cookies in some cases. Cookies do not damage your computer and contain no viruses. They make our services more user friendly effective and secure. Cookies are small text files stored on your device by your browser.
Most cookies we use are session cookies which are automatically deleted at the end of your visit. Other cookies remain stored until you delete them. These allow us to recognize your browser upon your next visit.

Cookies necessary for communication or certain functions such as a shopping cart are stored based on a legitimate interest. Google Analytics
Jicki Services use Google Analytics a web analytics service from Google Inc. 1600 Amphitheatre Parkway Mountain View CA 94043 USA. The use includes the Universal Analytics mode which enables analysis across devices via a pseudonymous user ID.
Google Analytics uses cookies that allow analysis of website use. The information generated is usually transferred to a Google server in the USA and stored there. If IP anonymization is activated Google shortens IP addresses within EU member states or other EEA countries. Only in exceptional cases is the full IP address transmitted to the USA and shortened there. IP addresses transmitted by your browser are not merged with other Google data. Google evaluates website use compiles activity reports and provides further services related to internet use on behalf of the website operator. This is also our legitimate interest. Legal basis is § 15 para. 3 TMG and Art. 6 para. 1 lit. f GDPR. Sessions and campaigns end after certain time periods. Sessions end after 30 minutes without activity and campaigns after six months. Campaign limits can be up to two years.
You can prevent storage of cookies in your browser settings. You can also prevent collection and processing of data by Google by installing the browser add on provided by Google. Google Firebase and Google Cloud Platform
Our apps and websites use Google Firebase technology Google Inc. 1600 Amphitheatre Parkway Mountain View CA 94043 USA. Firebase is part of the Google Cloud Platform and offers numerous services. Some process personal data usually limited to instance IDs with timestamps which allow linking of events but do not identify individuals. We do not attempt to personalize these IDs. We analyze aggregated data for usage optimization including crash reports.

Firebase Cloud Messaging is used for push notifications or in app messages. Devices receive a pseudonymous push reference that serves as the destination for messages. Push notifications can be disabled anytime in device settings.
We do not use Firebase services that involve personal identifiers such as IP addresses emails phone numbers or passwords. We use EU servers whenever possible but data transfer to the USA cannot be excluded. Google participates in the EU US Data Privacy Framework.
We have data processing agreements with Google. Google is obligated to protect user data process it according to our terms and not share it with third parties.
You may object to the use of cookies and profiling at any time.
Google AdWords and Conversion Tracking
Jicki Services use Google AdWords and its conversion tracking. When you click an ad a conversion cookie is set. Cookies expire after thirty days and do not identify users personally. If the cookie is still active Google and we see that a user reached a certain page after clicking an ad.
Each AdWords customer receives a unique cookie. Data collected through conversion cookies creates statistics for customers using conversion tracking. Customers learn how many users clicked their ad and reached a conversion tagged page but receive no data identifying individuals. You may block this tracking by disabling the conversion cookie in your browser settings.
Conversion cookies are stored based on legitimate interest since they help us analyze user behavior to optimize web offerings and advertising.

YouTube
Jicki Services use plugins from YouTube operated by YouTube LLC 901 Cherry Ave. San Bruno CA 94066 USA. When visiting a page with a YouTube plugin a connection to YouTube servers is established. YouTube is informed which page you visited.
If logged in to your YouTube account YouTube can associate your browsing with your profile. You may prevent this by logging out.
Using YouTube serves the interest of providing appealing online content which represents a legitimate interest.

Jicki Services use the Facebook Pixel by Facebook Inc. USA or Facebook Ireland Ltd. for EU users. Processing is based on Art. 6 para. 1 f GDPR since it enables targeted advertising toward users who have visited our site.
Use of SoundCloud
Jicki Services use SoundClouds player. SoundCloud uses cookies. Data is not used to identify visitors personally. See SoundClouds privacy policy for further details.
FreshDesk Ticket System
We use the cloud based ticketing service Freshdesk Freshworks GmbH Alte Jakobstraße 85 86 Hof 3 Haus 6 10179 Berlin Germany for email support. Data is processed via SSL and data centers comply with EU Safe Harbor standards. Privacy info at Freshworks GDPR page.
Transfer of your data to FreshDesk is based on Art. 6 para. 1 lit. a GDPR consent. You may withdraw consent anytime with no effect on past processing. Freshworks Inc. participates in the EU US Data Privacy Framework.
Changes to this Privacy Policy
We may update this Privacy Policy to comply with legal requirements or reflect changes in our services. The new Privacy Policy applies to future visits.
