Welcome to the privacy policy of Jicki GmbH. Here we inform you which data is collected and how it is used. This privacy policy applies to all websites and apps of Jicki GmbH hereinafter referred to as Jicki services.

Collection and processing of personal data

Personal data such as name address customer number and email address is collected within the scope of the Jicki services only if you voluntarily provide this information to us for example during registration through an email inquiry an online application a survey a competition or for the execution of an order.

These personal data are collected and used in accordance with the applicable legal regulations for the protection of personal data solely for the purpose of contract or order processing and to safeguard our own legitimate business interests with regard to advising and supporting our customers and designing products according to demand. These data are never passed on to third parties without your explicit consent unless we are legally obliged to do so.

In the event of your explicit prior consent or on the basis of legal permission under data protection law we also use the data for the purpose of advertising our own and third party products and services as well as for market and opinion research. You may object to the use of your personal data for these purposes at any time by telephone email fax or by post.

Your right to access information and correction

You may request information about the personal data concerning you that we process. If your information is no longer accurate you may request correction.

If your data is incomplete you may request that it be completed. If we have shared your information with third parties we will inform those third parties of the correction where this is required by law.

Your right to deletion of your personal data

For the following reasons you may request the immediate deletion

of your personal data:

  • if your personal data is no longer required for the purposes for which it was collected
  • if you withdraw your consent and there is no other legal basis
  • if you object to the processing and there are no overriding legitimate grounds for processing
  • if your personal data has been processed unlawfully
  • if your personal data must be deleted to comply with legal requirements

Please note that a right to deletion depends on whether there is a legitimate reason that requires the processing of the data.

Your right to restriction of the processing of your personal data

  • if you contest the accuracy of your personal data and we had the opportunity to verify the accuracy
  • if the processing is unlawful and you request restriction of use instead of deletion

Your right to object

We may process your data on the basis of legitimate interests or in the public interest. In these cases you have the right to object to the processing of your data.

Your right to data portability

You have the right to receive personal data that you have provided to us in a transferable format.

Your right to withdraw consent

If you have given us consent to process personal data for specific purposes the processing of this data is lawful. You may withdraw your consent at any time. This also applies to the withdrawal of consent declarations that you gave to us before the applicability of the GDPR General Data Protection Regulation meaning before May 25 2018. The withdrawal of consent does not affect the lawfulness of the data processed up to the time of withdrawal.

Purpose of data storage

We observe the principle of purpose limitation and collect process and store your personal data only to enable maintain and further develop the offerings of the Jicki services. Your personal data will not be passed on to third parties without your explicit consent unless this is necessary for the provision of the service or for contract performance. Disclosure to authorized government institutions and authorities also takes place only within the scope of statutory information obligations or if we are obliged to provide information by a court decision.

We also take internal data protection very seriously. Our employees and the service providers commissioned by us are obligated by us to confidentiality and to comply with data protection regulations.

In the case of payment processing we pass on the data required to complete the payment transaction to the payment service provider. If you transmit your payment data directly to a payment service provider we receive only a very limited set of data. The payment provider only informs us whether the transaction was completed under a specific transaction number. In this case we do not receive your bank details or your credit card number. In the event of an infringement of third party rights especially copyright trademark name and identification rights by the user the user data will be passed on to the rights holder only if the rights holder substantiates their claims to Jicki GmbH.

Minors

The services of Jicki GmbH are generally aimed at adult users. Use by minors without the consent of their legal guardians is not permitted. Jicki GmbH therefore reserves the right to delete all data relating to minor users if no consent has been given by the legal guardians.

Emails

We send emails for various reasons in order to enable you to use our learning platform. Following the registration and payment process we send you a registration confirmation or an order confirmation. Emails may also relate to our services and offers provided that you have not objected to such use of your data. You may object at any time by using the unsubscribe link in the respective email or by sending an email to info@jicki.com.

Emails sent by us are stored by us and emails that are considered business correspondence are not deleted during the statutory retention period. In our newsletter emails we record for example via so called tracking pixels whether an email has been opened and which links in the email were clicked for the purpose of optimizing and improving the presentation of our offers. We use this data exclusively to send you relevant and interesting content. If you wish to object to this use of data you may do so by unsubscribing from our newsletter using the unsubscribe link in the respective email.

Use of the mailing service provider Maileon

The newsletters are sent via Maileon an email newsletter provider based in Germany XQueue GmbH Christian Pleß Str. 11 to 13 63069 Offenbach am Main

The email addresses of our newsletter recipients as well as other data described in these notices are stored on Maileon servers in Germany. Maileon uses this information to send and evaluate the newsletters on our behalf. Furthermore according to its own information Maileon may use this data to optimize or improve its own services for example for technical optimization of delivery and presentation of newsletters or for economic purposes to determine from which countries the recipients originate. However Maileon does not use the data of our newsletter recipients to contact them itself or to pass the data on to third parties.

Registration data

To subscribe to the newsletter it is sufficient to provide your first name and your email address.

Optionally we ask you to provide your last name. This information is used solely to personalize the newsletter.

Statistical collection and analyses

The newsletters contain a so called web beacon meaning a pixel sized file that is retrieved from the Maileon server when the newsletter is opened. In the course of this retrieval technical information such as information about the browser and your system as well as your IP address and the time of access are initially collected. This information is used to technically improve the services based on the technical data or the target groups and their reading behavior based on the locations of access which can be determined using the IP address or the access times.

The statistical evaluations also include determining whether newsletters are opened when they are opened and which links are clicked. For technical reasons this information can be assigned to individual newsletter recipients. However neither we nor Maileon aim to monitor individual users. Rather the evaluations help us understand the reading habits of our users and adapt our content to them or send different content according to the interests of our users.

Online access and data management

There are cases in which we direct newsletter recipients to Maileon websites. For example our newsletters contain a link that allows recipients to view the newsletter online for example in the event of display issues in the email program. Furthermore newsletter recipients can subsequently correct their data such as their email address.

In this context we point out that cookies are used on Maileon websites and that personal data is processed by Maileon its partners and service providers used for example Google Analytics. We have no influence on this data collection. Further information can be found in the privacy policy of Maileon.

Termination withdrawal

You may cancel receipt of our newsletter at any time meaning withdraw your consent. At the same time your consent to its delivery via Maileon and the statistical analyses will also expire. Unfortunately a separate withdrawal of delivery via Maileon or of the statistical analysis is not possible.

You can find a link to cancel the newsletter at the end of each newsletter.

Legal bases under the General Data Protection Regulation

In accordance with the requirements of the General Data Protection Regulation GDPR applicable as of May 25 2018 we inform you that consent to the sending of email addresses is based on Art. 6 para. 1 lit. a 7 GDPR as well as § 7 para. 2 no. 3 or para. 3 UWG. The use of the mailing service provider Maileon the performance of statistical surveys and analyses as well as logging of the registration process are based on our legitimate interests pursuant to Art. 6 para. 1 lit. f GDPR. Our interest is aimed at using a user friendly and secure newsletter system that serves both our business interests and the expectations of users.

We also inform you that you may object at any time to the future processing of your personal data in accordance with the legal requirements pursuant to Art. 21 GDPR. The objection may in particular be made against processing for purposes of direct advertising.

Collection of general information

When you access our website information of a general nature is automatically collected. This information server log files includes for example the type of web browser the operating system used the domain name of your internet service provider and similar information. This is exclusively information that does not allow any conclusions to be drawn about your person. This information is technically necessary in order to correctly deliver website content requested by you and is mandatory when using the internet. Anonymous information of this kind is statistically evaluated by us in order to optimize our website and the underlying technology.

Cookies

The Jicki services partially use so called cookies. Cookies do not cause any damage to your computer and do not contain viruses. Cookies serve to make our offering more user friendly more effective and more secure. Cookies are small text files that are stored on your computer and saved by your browser.

Most of the cookies we use are so called session cookies. They are automatically deleted after the end of your visit. Other cookies remain stored on your device until you delete them. These cookies enable us to recognize your browser on your next visit.

This makes it possible to assign data sessions and interactions across multiple devices to a pseudonymous user ID and thus analyze the activities of a user across devices.

Google Analytics uses so called cookies text files that are stored on your computer and enable an analysis of your use of the website. The information generated by the cookie about your use of this website is generally transmitted to a Google server in the USA and stored there. If IP anonymization is activated on this website your IP address will however be truncated by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area beforehand. Google Firebase and the Google Cloud Platform

Our apps and websites use technology from Google Firebase Google Inc 1600 Amphitheatre Parkway Mountain View CA 94043 USA Google. Some Firebase services process personal data. In most cases personal data is limited to so called instance IDs which are provided with a timestamp. These instance IDs assigned by Firebase are unique and thus allow the linking of different events or processes. For us this data does not constitute personally identifiable information nor do we make any effort to subsequently personalize it. We process this aggregated data to analyze and optimize usage behavior for example by evaluating crash reports.

For Firebase Analytics Google uses not only the instance ID described above but also the advertising ID of the device. You can restrict the use of the advertising ID in the settings of your mobile device.

Firebase Cloud Messaging is used to deliver push notifications or so called in app messages meaning messages that are displayed only within the respective app. A pseudonymized push reference is assigned to the device which serves as the target for push notifications or in app messages. Push notifications can be disabled and re enabled at any time in the device settings.

We do not use Firebase services that process personally identifiable information such as IP addresses email addresses phone numbers or passwords. Where possible we use servers located within the EU. However it cannot be ruled out that data may also be transferred to the USA. Google is part of the EU US Data Privacy Framework. Furthermore we have concluded several data processing agreements with Google. In these agreements Google commits to protecting the data of our users to processing it on our behalf in accordance with its data protection provisions and in particular not to pass it on to third parties.

You may object at any time to the setting or processing of cookies and the associated profiling via our website.

Google AdWords and Google Conversion Tracking

The Jicki services use Google AdWords. AdWords is an online advertising program of Google Inc 1600 Amphitheatre Parkway Mountain View CA 94043 United States Google.

As part of Google AdWords we use so called conversion tracking. When you click on an ad placed by Google a cookie for conversion tracking is set. Cookies are small text files that the internet browser stores on the user computer. These cookies expire after 30 days and are not used for personal identification of users. If the user visits certain pages of this website and the cookie has not yet expired Google and we can recognize that the user clicked on the ad and was redirected to that page.

Each Google AdWords customer receives a different cookie. The cookies cannot be tracked across the websites of AdWords customers. The information obtained using the conversion cookie is used to create conversion statistics for AdWords customers who have opted for conversion tracking. Customers learn the total number of users who clicked on their ad and were redirected to a page tagged with a conversion tracking tag. However they do not receive any information that allows users to be personally identified. You will then not be included in the conversion tracking statistics.

The storage of conversion cookies is based on a legitimate interest. The website operator has a legitimate interest in analyzing user behavior in order to optimize both its web offering and its advertising.

Our Jicki services partially use plugins from the Google operated site YouTube. The site is operated by YouTube LLC 901 Cherry Ave San Bruno CA 94066 USA.

When you visit one of our pages equipped with a YouTube plugin a connection to the YouTube servers is established. The YouTube server is informed which of our pages you have visited.

If you are logged into your YouTube account you enable YouTube to directly associate your browsing behavior with your personal profile. You can prevent this by logging out of your YouTube account.

The use of YouTube is in the interest of an appealing presentation of our online offerings. This constitutes a legitimate interest within the meaning of the General Data Protection Regulation.

Our Jicki services partially integrate Facebook pixels which are provided by Facebook Inc based in the USA or if you access our Jicki services from the EU by Facebook Ireland Limited based in Ireland. The integration and processing of your data by the Facebook pixel is based on Art. 6 para. 1 sentence 1 f GDPR because this enables us to place more targeted advertisements on Facebook as they can be shown specifically to people who have previously visited our website.

Use of SoundCloud

The Jicki services partially use the SoundCloud player. SoundCloud uses cookies which are text files stored on your computer. The data is processed exclusively via SSL and the data centers comply with EU Safe Harbor guidelines. The transfer of your data to FreshDesk is based on Art. 6 para. 1 lit. a GDPR consent. You have the option to withdraw your consent to data processing at any time. A withdrawal does not affect the lawfulness of data processing operations carried out in the past.
